These Terms and Conditions govern purchases made through bulkgenetics.com (hereinafter, the "Website") and form part of the contract entered into between the customer and GLOBAL WEB MARKT, S.L..
Before placing an order, the customer must read these terms and conditions. By making a purchase, the customer accepts the version in force at the time the order is placed.

2. Scope
These terms and conditions apply to the purchase of products offered by Bulk Genetics through the Website.
Where the purchaser qualifies as a consumer or user, the rights recognised under Spanish and European consumer protection legislation shall apply.
Nothing in these terms and conditions is intended to exclude or limit rights that cannot legally be waived under applicable law.
3. Minimum age
Purchases from Bulk Genetics are strictly limited to persons aged 18 or over.
By placing an order, the customer declares that they are at least 18 years old and have sufficient legal capacity to enter into the contract.
Bulk Genetics may cancel an order where there are reasonable grounds to believe that the purchaser does not meet the minimum age requirement.
4. Characteristics and intended purpose of the seeds
The cannabis seeds sold by Bulk Genetics are offered as hobbyist or collectible seeds for strictly personal use.
They are not intended for agricultural use or for establishing crops.
Laws relating to cannabis seeds and their acquisition, possession, importation, use, germination or cultivation may vary considerably depending on the country, region or territory.
It is the customer's responsibility to check the legislation applicable in their place of residence and at the destination of the order before making a purchase.
Bulk Genetics does not promote or authorise any unlawful use of the products sold and shall not be responsible for any use contrary to applicable law by the purchaser or any third party.
The technical ability to place an order from a particular country or territory does not constitute any representation or guarantee by Bulk Genetics that the acquisition, importation, possession, germination, cultivation or use of the product is lawful in that territory.
Bulk Genetics may refuse or cancel orders destined for territories where it is aware of legal restrictions that reasonably prevent the sale or shipment of the products.
5. Genetic information and strain characteristics
Seeds are biological material and natural variations may occur between individual specimens of the same strain.
Information provided on product pages concerning, among other matters, genetics, dominance, cannabinoids, terpenes, aromas, flavours, morphology, colouration, flowering or development times, production, yield or similar characteristics is descriptive and indicative in nature.
Any results observed in a plant depend on numerous genetic, environmental and handling factors and therefore cannot be guaranteed to be identical for all specimens.
Photographs of plants, flowers or results associated with a strain are also provided for illustrative purposes and may show specific phenotypes or individual specimens.
The above does not affect the consumer's statutory rights regarding the conformity of the product supplied, including, where applicable, its identity, strain, quantity, integrity, presentation and any other contractually agreed characteristics.
6. Product availability
All orders are subject to availability.
If a product becomes unavailable after an order has been placed, Bulk Genetics will inform the customer as soon as possible and, as appropriate, offer a refund of the amount paid or an alternative which the customer may freely accept or reject.
A purchased product will not be replaced with a different product without the customer's consent.
7. How to place an order
To make a purchase, the user must select the desired products and add them to the basket.
Before confirming the order, the customer will be able to review the selected products, quantities, prices, delivery address, delivery method and other purchase details, as well as correct any errors.
During checkout, the payment and delivery methods available for the selected destination will be displayed.
Before completing the purchase, the total amount payable will be displayed, including applicable taxes and delivery charges.
Final confirmation of the purchase will be made using a button or action that clearly indicates that placing the order entails an obligation to pay.
8. Order confirmation and formation of the contract
Once the order has been successfully placed, Bulk Genetics will send confirmation to the email address provided by the customer during checkout.
The confirmation will include the essential order information and the relevant contractual information will be provided on a durable medium, including the terms and conditions applicable to the purchase.
The contract shall be deemed concluded when Bulk Genetics confirms acceptance of the order.
Bulk Genetics will retain electronic information relating to transactions for the periods necessary to manage the contractual relationship and comply with its legal obligations.
9. Contract language
The contract may be concluded in any of the languages offered by Bulk Genetics on the Website.
The language applicable to each purchase shall be the language selected by the customer during checkout.
10. Prices and taxes
The applicable prices shall be those published on the Website at the time the order is placed, except in the case of an obvious error.
Before confirming the purchase, the total amount payable will be displayed to the customer.
For orders destined for European Union countries, the applicable VAT rate may vary depending on the destination country in accordance with the tax rules governing distance sales. The relevant VAT rate will be determined once Bulk Genetics has the information necessary to establish the order destination.
The final price displayed before the order is confirmed will include applicable taxes and the corresponding delivery charges.
For orders sent outside the European Union, the price may not include import duties, taxes, tariffs, customs clearance charges or other amounts imposed by the authorities in the destination country.
Where these charges cannot be collected by Bulk Genetics at checkout, they shall be the responsibility of the recipient in accordance with the legislation applicable in the destination country.
11. Pricing errors
Bulk Genetics endeavours to keep product and pricing information accurate and up to date. Nevertheless, obvious errors may occur.
If an evident pricing error is identified before the order is dispatched, the customer will be informed and given the option to confirm the purchase at the correct price or cancel the order and receive a full refund of any amounts paid.
12. Payment methods
The customer may use the payment methods enabled on the Website for their country or order.
Available methods may include:
- Credit or debit card: processed through our specialist provider Costplus OÜ (Cost+).
- Bank transfer: to the bank accounts indicated during or after checkout.
- Cryptocurrencies: Bitcoin and other cryptocurrencies listed on the payment methods page.
- Other methods on request: such as Skrill, Western Union, Moneygram or postal money order, by prior request to info@bulkgenetics.com.
The availability of each payment method may depend on the destination country, order value or other operational or security criteria.
For payments by bank transfer, the order may remain pending until Bulk Genetics has confirmed actual receipt of the funds.
Card payments are processed by specialist payment providers. Bulk Genetics does not ordinarily store the full card details used to make a payment.
13. Fraud prevention
Bulk Genetics may carry out reasonable checks to prevent fraudulent transactions or unauthorised use of payment methods.
Where there are objective indications of fraud, unauthorised use of a payment method or manifestly incorrect information, Bulk Genetics may temporarily suspend processing of the order while the necessary checks are carried out.
Where a transaction must be cancelled, any amounts charged will be refunded in accordance with applicable law.
14. Delivery
Bulk Genetics delivers to the destinations enabled on the Website.
Available delivery options depend on the country, postcode, characteristics of the order and services available at each destination.
Orders may be transported by, among other carriers:
- Correos.
- Nacex.
- UPS.
Logistics management for certain shipments may be carried out through Sendcloud.
Before confirming the order, the customer will be informed of the available delivery options and their cost.
15. Delivery times
Estimated preparation and delivery times will be indicated on the Website, during checkout or in the order confirmation, depending on the destination and delivery method selected.
Delivery times are estimates where they depend on carriers, customs procedures, public holidays, weather conditions, logistical incidents or other factors beyond the reasonable control of Bulk Genetics.
If a significant delay occurs, Bulk Genetics will endeavour to inform the customer and will act in accordance with the rights granted to the customer under applicable law.
16. Delivery address
The customer is responsible for providing a complete and accurate delivery address.
If an error is identified, the customer must contact Bulk Genetics as soon as possible at info@bulkgenetics.com.
If the order has not yet been dispatched, we will attempt to amend the address.
Where delivery cannot be completed due to an incorrect or incomplete address or another circumstance attributable to the recipient, any additional delivery costs that are reasonable and legally recoverable may be charged.
17. Risk during transport
Where the purchaser is a consumer, the risk of loss or damage to the products will pass to the consumer when they, or a third party designated by them other than the carrier, take physical possession of the goods, except where otherwise provided by law.
If an order arrives with visible damage to the packaging, we recommend noting this with the carrier and informing Bulk Genetics as soon as possible in order to facilitate handling of the issue.
Failure to report transport damage immediately does not remove any statutory rights available to the consumer.
18. International deliveries and customs
For international deliveries, the customer is responsible for checking before placing an order that the purchased products may lawfully be imported, received and possessed in the destination country or territory.
Orders may be subject to customs controls, inspections, delays, import taxes or other measures imposed by the competent authorities.
Bulk Genetics has no control over decisions made by customs, administrative or judicial authorities in third countries.
Where an order is affected by legal restrictions, detention, seizure or other action by a public authority, each case will be handled taking into account the specific circumstances, applicable law and any mandatory consumer rights.
19. Cancelling an order before dispatch
The customer may request cancellation of an order by writing to info@bulkgenetics.com.
If the order has not yet been dispatched and it is possible to stop its preparation or shipment, Bulk Genetics will cancel it and refund the amounts paid.
Once the order has been dispatched, any return will be governed by the rules relating to the right of withdrawal and any other rights applicable by law.
20. Right of withdrawal
Where the purchaser qualifies as a consumer and no statutory exception applies, they shall have the right to withdraw from the contract without giving any reason within 14 calendar days.
As a general rule, the period begins on the day on which the consumer, or a third party designated by them other than the carrier, acquires physical possession of the goods.
Where a single order contains several products delivered separately, the period will begin upon receipt of the last product where this is required by law.
21. How to exercise the right of withdrawal
The consumer may communicate their decision to withdraw by means of an unequivocal statement before the applicable period expires.
This may be done through:

- The model withdrawal form included at the end of these terms and conditions.

22. Digital withdrawal function
During the statutory withdrawal period, Bulk Genetics will make available to consumers a clearly identified online function enabling them to communicate electronically their decision to withdraw from the contract.
Only the information necessary to identify the consumer and the relevant contract or order will be required to process the request.
Once the request has been submitted, Bulk Genetics will send confirmation of receipt on a durable medium without undue delay.
23. Returning products following withdrawal
Once withdrawal has been communicated, the consumer must return the products without undue delay and, in any event, within 14 calendar days following notification of their decision.
Unless Bulk Genetics expressly provides different instructions or a different address for a particular return, products must be sent to:

Unless Bulk Genetics expressly states otherwise, the consumer shall bear the direct cost of returning the goods.
The product must be returned suitably protected and accompanied by any elements forming part of it.
24. Condition of returned products
The consumer shall only be liable for any diminished value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning.
In the case of seeds, the condition of packaging, seals, labels, batch identification and contents may be relevant when determining whether a reduction in value has occurred.
Opening or handling the product shall not affect any statutory rights available to the consumer in relation to lack of conformity.
25. Refund following withdrawal
Where the right of withdrawal has been exercised correctly, Bulk Genetics will refund the payments received, including the cost corresponding to the least expensive standard delivery method offered for the order.
If the customer expressly chose a delivery method that was more expensive than the standard option, Bulk Genetics will not be required to refund the additional cost.
Unless otherwise agreed, the refund will be made using the same payment method used for the purchase and without any charge to the consumer.
The refund will be made within the statutory period applicable from the date on which Bulk Genetics is informed of the decision to withdraw.
Bulk Genetics may withhold the refund until it has received the products or until the consumer provides sufficient evidence that they have sent them back, whichever occurs first.
26. Lack of conformity and other issues
Products supplied must correspond to what was agreed and comply with the conformity requirements imposed by applicable consumer legislation.
If the customer receives an incorrect product, a different quantity from that purchased, an incomplete package, a damaged product or identifies any other possible lack of conformity, they should contact us at:
To assist in verifying the issue, we may reasonably request information such as the order number, photographs of the product or packaging, batch identification or other elements directly related to the claim.
Requesting this information will not limit the consumer's statutory rights.
27. Specific conformity of seeds
Bulk Genetics is responsible for lack of conformity of products in accordance with applicable law.
In the specific case of seeds, possible lack of conformity may include, among other circumstances and where applicable:
- Delivery of a strain different from the one purchased.
- A quantity lower than that ordered.
- Products or packaging arriving damaged where this affects the conformity of the product.
- The absence of a characteristic that had been expressly established as a contractual condition of sale.
Biological characteristics dependent on subsequent plant development, environmental conditions or handling do not in themselves constitute a guarantee of results.
This provision is not intended to exclude any mandatory statutory rights available to the consumer under applicable law.
28. Commercial germination guarantee
Without prejudice to the consumer's statutory rights, Bulk Genetics offers a limited commercial germination guarantee for seeds sold under the Bulk Genetics brand.
The guarantee may be claimed within 30 calendar days of receipt of the order and applies exclusively where the germination of cannabis seeds is lawful in the territory in which the customer is located.
To make a claim, the customer must contact info@bulkgenetics.com. Bulk Genetics may request:
- Order number.
- Affected strain.
- Number of affected seeds.
- Photographs or other information reasonably necessary to assess the issue.
The guarantee exclusively covers cases where a seed fails to germinate.
Once germination has occurred, circumstances relating to subsequent plant development, phenotype, sex, yield, production, flowering, cannabinoid concentration, aromas, organoleptic characteristics or any other results dependent on genetic, environmental or handling factors fall outside this commercial guarantee.
The guarantee will not apply where there are reasonable indications of improper storage, damage occurring after delivery, incorrect handling or any other circumstance unrelated to the original quality of the seeds.
Where a claim is accepted, Bulk Genetics may replace the affected seeds or provide an equivalent solution, taking into account the circumstances and product availability.
The guarantee is limited to one claim relating to the affected seeds from each order.
The existence of this guarantee does not constitute authorisation, recommendation or encouragement to carry out activities prohibited by applicable law.
The terms of this guarantee are also available on the Website's dedicated Germination Guarantee page.
This commercial guarantee is additional to and does not limit or replace the consumer's statutory rights regarding product conformity.
29. Promotions, gifts and free seeds
Bulk Genetics may offer promotions, discount codes, free seeds, gifts or other incentives associated with particular orders.
The specific terms of each promotion, including its duration, participating products, minimum spend or possible incompatibilities, will be those stated in each case.
Free or promotional products have no independent refundable value, without prejudice to any rights the customer may have where such products form part of a contractual offer.
30. Discount codes
Promotional codes are subject to the terms communicated for each campaign.
Unless otherwise stated, they may be limited by date, product, minimum spend, number of uses or customer and may not necessarily be combined with other promotions.
Bulk Genetics may invalidate codes obtained or used through fraud, technical manipulation, manifest error or breach of their specific terms.

Bulk Genetics will endeavour to resolve issues directly with the customer before resorting to other dispute resolution mechanisms.
32. Alternative consumer dispute resolution
Where the customer qualifies as a consumer, they may, where applicable, use the alternative dispute resolution mechanisms provided for under consumer legislation.
The European Commission provides information and a list of accredited alternative dispute resolution bodies in the Member States of the European Union.

33. Data protection
Personal data provided during checkout will be processed in accordance with our Privacy Policy.

34. Internal use of artificial intelligence tools
GLOBAL WEB MARKT, S.L. may use artificial intelligence tools provided by third parties, including OpenAI and Anthropic, as internal support for certain writing, translation, analysis, programming, support or process management tasks.
These tools are not currently used to set personalised prices or to make, solely by automated means, contractual decisions that produce legal effects concerning customers or similarly significantly affect them.
Where these tools involve the processing of personal data, such processing will be carried out in accordance with our Privacy Policy.
35. Customer responsibilities
The customer must provide accurate, complete and up-to-date information during checkout.
The customer will be responsible for loss, damage or costs reasonably arising from incorrect information attributable to them, such as an incorrect delivery address, without prejudice to any statutory rights available to them.
The customer also undertakes to use purchased products lawfully and in accordance with applicable law.
36. Limitation of liability
Bulk Genetics shall not be liable for damage arising from unlawful, negligent or otherwise improper use of purchased products contrary to these terms and conditions, or from circumstances beyond its reasonable control.
Bulk Genetics shall also not be responsible for acts of third parties or public authorities that are reasonably beyond its control, without prejudice to the obligations legally imposed on the seller.
No limitation contained in these terms and conditions shall exclude liability that cannot lawfully be excluded or reduce mandatory rights recognised for consumers and users.
37. Force majeure
Neither party shall be responsible for failure or delay caused by unforeseeable or unavoidable events outside its reasonable control, in accordance with applicable law.
Where such circumstances affect an order, Bulk Genetics will inform the customer where reasonably possible and take appropriate measures to reduce their consequences.
38. Changes to these terms and conditions
GLOBAL WEB MARKT, S.L. may amend these Terms and Conditions to reflect legal, operational or commercial changes.
Changes will not apply retroactively to orders already concluded. Each purchase will be governed by the version in force at the time the contract was entered into.
39. Applicable law and jurisdiction
These terms and conditions are governed by Spanish law and by applicable European Union legislation.
Where the customer qualifies as a consumer or user, any dispute will be resolved before the courts and tribunals having jurisdiction under mandatory consumer protection rules, and the jurisdiction legally available to the consumer will be respected.
Where the purchaser acts as a business or professional and the law permits jurisdiction to be agreed, the parties submit to the courts and tribunals corresponding to the registered address of GLOBAL WEB MARKT, S.L., unless mandatory law provides otherwise.
